What the Natrium Construction Permit Actually Means — And What Still Has to Happen

Intended audience: Investors and advanced reactor developers trying to understand what a construction permit does and doesn't authorize, using TerraPower's Natrium project as the reference case.


Executive Summary


On July 21, 2026, TerraPower became the first advanced reactor company ever accepted into the Institute of Nuclear Power Operations (INPO), a voluntary industry body dedicated to operational excellence at commercial nuclear plants. It's a real signal that TerraPower is maturing its organization ahead of operations. But it follows, and shouldn't be confused with, the actual regulatory milestone: on March 4, 2026, the U.S. Nuclear Regulatory Commission (NRC) issued TerraPower a construction permit (CP) for the Natrium reactor at Kemmerer, Wyoming, the first commercial non-light-water reactor construction permit in more than 40 years. That permit authorizes construction of the reactor's safety-related structures, systems, and components. It does not authorize TerraPower to load fuel or sell electricity. A separate Operating License Application (OLA), which TerraPower has told the NRC it plans to file by March 2028, still has to be submitted, reviewed, and approved before Natrium generates a single watt of commercial power. This post walks through what a CP actually authorizes, what the OL review still has to verify, and why a smaller developer pursuing 10 CFR Part 50, the same pathway TerraPower used, should see that gap as a strategic advantage, not a warning sign.


TerraPower Joins INPO: A Real Signal, Correctly Read


INPO membership is voluntary. Nuclear operators join it because INPO's mission, promoting excellence in the operation of commercial nuclear power plants, is one the nuclear industry holds itself to beyond what regulation requires. TerraPower's acceptance as the first advanced reactor company ever admitted is a genuine sign that the organization is building out the operational discipline a nuclear power plant will eventually need, well ahead of actually operating one.


What it isn't is a regulatory approval. INPO doesn't issue licenses, and membership doesn't move TerraPower any closer to loading fuel. It's organizational maturity, running on a parallel track to the licensing process, not a substitute for it.


Worth noting how unusual this is: NuScale, the sector's furthest-along developer on the regulatory front with two NRC-approved standard designs, is not yet a full INPO operating member. TerraPower reaching that milestone before NuScale underscores that INPO membership tracks organizational and operational readiness, not licensing progress, and the two don't necessarily move together.


What a Construction Permit Actually Authorizes


A 10 CFR Part 50 construction permit authorizes construction of the safety-related structures, systems, and components (SSCs) described in the application, not construction in general. TerraPower used that distinction deliberately, and put the technical basis for it on the record with the NRC: in a February 28, 2025 filing (TP-LIC-LET-0382, ADAMS ML25059A093), TerraPower requested an exemption and submitted a supporting topical report (NATD-LIC-RPRT-0001-A) arguing that the Energy Island's molten-salt storage system should be classified as non-safety-related, allowing its construction to proceed ahead of receiving the NRC construction permit itself. The NRC agreed. The exemption was granted effective May 7, 2025, with the agency stating in its Federal Register notice (Vol. 90, No. 93, May 15, 2025, pages 20692–20695) that the exempted work presented no undue risk to public health and safety.


Most reactor designs can't make this split. In a conventional nuclear power plant, a turbine trip on the secondary side propagates back into the reactor core as a reactivity transient, which typically forces a reactor trip and full shutdown. The core and the turbine are tightly coupled; lose the turbine, and the core has to respond. Natrium's molten-salt energy storage changes that coupling. The large hot and cold salt tanks can absorb the reactor's heat output independently of what the turbine is doing, so a turbine trip produces no feedback into the core. The reactor can keep running and simply dump heat into the hot salt tank instead of shutting down. That's the technical basis TerraPower put in front of the NRC for why the Energy Island, which handles that heat storage and the turbine-side power conversion, could be classified as non-safety-related in the first place: a turbine trip doesn't compromise the reactor's ability to control reactivity or maintain safe shutdown and cooling, because the reactor's safety functions don't depend on the Energy Island operating.


With that exemption granted, TerraPower broke ground on Energy Island construction well ahead of the NRC's construction permit decision, in June 2024. Once the CP was issued in March 2026, full construction, including the safety-related SSCs that actually required NRC authorization, could begin. What none of that construction authorizes, safety-related or not, is loading fuel or generating electricity for sale. That requires a separate Operating License, applied for and reviewed independently of the construction permit.


What Still Has to Happen: The Operating License Application


An Operating License Application is where every commitment made during the construction permit stage gets verified as actually met. The safety analysis has to be complete. Every loose end from the CP stage has to be tied up and demonstrated, not just described. TerraPower has told the NRC, in a public meeting, that it plans to submit its Operating License Application by March 2028, roughly two years after the construction permit was issued and roughly two years before the company's targeted 2030 completion date. That's a tight window: the OL review itself, plus construction completion and startup testing, all need to happen inside those final two years.


Here's where the comparison to 10 CFR Part 52 matters. Part 52 combined license applications use Inspections, Tests, Analyses, and Acceptance Criteria (ITAAC) as a formal, codified punchlist, specific criteria that must be inspected and verified before fuel load is authorized. Natrium is a Part 50 project, not Part 52, so it doesn't have formal ITAAC. But in practice, the Operating License review does the same job: it's the mechanism that confirms the plant was actually built the way it was designed, tested the way it needs to be tested, and is ready to operate the way the safety case says it will.


Why Part 50 Front-Loads Less Than Part 52, and Why That's Not a Weakness


The reason a construction permit can look like more progress than it represents is structural, not TerraPower's doing. Part 52's Combined License Application (COLA) pulls a large amount of design and analysis content forward into the initial application, content that, under Part 50, doesn't have to be finalized until the Operating License stage. A Part 52 COLA is supposed to contain substantially more technical detail upfront than a Part 50 construction permit application does.


That means a Part 50 CP is a genuinely easier bar to clear early than a Part 52 COL, not because the safety case is weaker, but because less of the total technical package is required at that stage. The rest gets built out and verified during the OL review that follows.


What This Means for Investors


TerraPower's leadership has been clear-eyed about this from the start: the OLA is a substantial, separate body of work, and Natrium cannot load fuel or sell power until the NRC issues that license. The risk isn't that TerraPower doesn't understand this. The risk is that investors evaluating other developers, especially earlier-stage ones, hear "construction permit," or now "INPO membership," and assume the hard regulatory work is behind them.


I've seen this play out directly, not just as a hypothetical. I've spoken with a developer who was treating their eventual construction permit as the endpoint of their licensing effort, when in reality it's the midpoint. A CP is a real regulatory milestone, and it deserves to be communicated as one. But it's not commercial operation, and framing it that way to investors sets up an expectations gap that shows up later, usually right when the developer needs investor confidence the most, heading into the Operating License Application development.


What Smaller Developers Should Take From This


For an earlier-stage developer choosing between licensing pathways, this is actually a reason to favor 10 CFR Part 50 over Part 52, not a caution against it. A construction permit application is a genuinely achievable, demonstrable regulatory milestone you can put in front of investors sooner than a full Part 52 COLA would allow. You get a real, NRC-validated proof point earlier in your company's life, while the deeper technical build-out continues into the OLA development.


The mistake would be presenting that CP milestone, or organizational milestones like INPO membership, to investors as if they were the finish line. They're real progress, and TerraPower is closer to commercial operation because of them. But a construction permit and an operating license answer two different questions, and conflating them sets an investor's expectations on the wrong timeline. Know which milestone you're actually standing on, and say so plainly.

A Part 52 combined license locks in the design and includes a formal ITAAC punchlist agreed to before construction even begins, so once construction is complete and ITAAC are verified, fuel load and operation follow with far less additional NRC review. That predictability matters most to developers building multiple units off a single certified design, or to larger, better-capitalized projects where investors and utility partners want the technical case settled early rather than staged across two separate applications. The tradeoff is cost and time upfront in exchange for a shorter, more predictable path from construction complete to operating. For a well-capitalized developer able to absorb that upfront cost, Part 52 can be the faster route to a bankable, standardized design.
